General Terms and Conditions

The following terms and conditions apply to prices, offers, orders, deliveries, agreements, and other documents from which obligations may arise for Garden plants for sale, excluding the customer’s own terms and conditions.
Any modification and/or addition is only binding after a written agreement between Garden plants for sale and the customer.
This sales agreement comes into effect after payment of the placed order. By doing so, you also legally accept the full general terms and conditions of sale.

1. Product Information:
Garden plants for sale makes every effort to ensure that the information provided is complete, accurate, and up to date. This information should give the buyer an idea of what the product will look like. Photos are taken depending on the season and are for illustration purposes only. All details such as dimensions, colors, etc., listed on the website may be subject to change and are not binding unless expressly confirmed in writing by Garden plants for sale. All prices on our website are subject to typographical errors. No liability is accepted for the consequences of such errors. Photos may not be copied or used for any purpose without prior written permission from Garden plants for sale. Garden plants for sale reserves the right to claim damages in case of infringement.

2. Prices:
All prices are quoted in € including VAT, also covering shipping and packaging costs. These costs are separately stated on the delivery note. Garden plants for sale reserves the right to adjust the price list according to market conditions. The invoice price is based on the price listed on the website at the time the order is registered. All plant prices are valid while stocks last.

3. Orders:
The right to withdraw from a distance purchase within 14 days does not apply to products that are perishable or sensitive to dying (Economic Law Code art.VI.53.4). Cancellation or modification of an order must be made within 24 hours after the order is registered. If you cancel your order, 25% of the purchase amount excluding VAT will be charged. A new delivery date comes into effect after registration of the amended order. Garden plants for sale reserves the right to refuse an order if it contains irregularities. The customer will be informed within 48 hours.

4. Delivery:
Although the statutory delivery period is 30 days after receipt of the order, Garden plants for sale will deliver goods within 5 to 15 working days after payment of the order, unless otherwise agreed in writing. We will ensure that the goods are delivered within the communicated timeframe. Any delay does not entitle the customer to cancel the order or claim damages. Upon unloading, goods will be placed on the ground floor next to or near the truck. Garden plants for sale cannot be held responsible for non-delivery in case of customer absence or incorrect address information. A new delivery can be scheduled with shipping costs at the customer’s expense. Customers may also collect products themselves according to the scheduled time. Given the nature of the products, the new delivery or pickup must occur within one week of the initial delivery date. If Garden plants for sale cannot deliver a product within the statutory 30-day period due to unavailability or lack of alternatives, the customer will be notified and refunded the amount paid for the product. When orders are sent via external courier, we ensure careful packaging with all necessary labels. We work with Bpost 24h, and delivery can be expected within 24 hours. Track and Trace is provided. Garden plants for sale is not responsible for delays due to force majeure.

5. Force Majeure:
Garden plants for sale is released from its obligations to deliver plants in case of crop failure, abnormal weather conditions, or other force majeure events. Force majeure includes strikes, fire, energy failures, operational disruptions, courier delays, telecommunications failures, late or non-delivery by suppliers, or unforeseen and insurmountable events caused by third parties. Garden plants for sale will notify the buyer in writing or by email.

6. Receipt of Goods:
The customer must inspect the delivery immediately upon receipt. Notifications made later than 24 hours after receipt will no longer be eligible for return or replacement. Attaching photos to illustrate any problem is recommended.

7. Collection of Goods:
For self-collection, Garden plants for sale cannot be held responsible for loss, theft, heat, frost, or other damage during transport by the customer. If collection is canceled, Garden plants for sale can deliver at the customer’s request, subject to retraction of benefits. Due to the nature of the products, a second collection must occur within 7 days to guarantee product quality.

8. Privacy:
Customer data provided to Garden plants for sale is only used for core activities, such as orders, offers, newsletters, etc. This data is not shared with third parties. Customers can object to receiving mailings, offers, or newsletters via email. Garden plants for sale is not responsible for data issues caused by external factors.

9. Shipments:
Underpaid or unpaid shipments will be returned to the sender. Goods returned or sent back to Garden plants for sale without prior email notification will not be accepted.

10. Warranty:
Garden plants for sale guarantees the authenticity of plants. The warranty is only valid if plants are further cultivated in open ground. The growth guarantee excludes death due to dehydration, insect or fungal infection, improper use of pesticides, severe winters, unsupported hedges, or unsupported trees. The growth guarantee applies from receipt of the plants. Species authenticity is guaranteed; regrowth is not. Any compensation cannot exceed the invoice amount excluding shipping. Garden plants for sale commits to responding to all complaints within 5 working days.

11. Dispute Resolution:
Belgian law applies to all legal relationships between the parties. In case of dispute, only the court of Veurne has jurisdiction.
