Right of withdrawal

Right of withdrawal according to Book VI – Art. VI.47 et seq. of the Belgian Code of Economic Law (WER)

You have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which you or a third party designated by you, who is not the carrier, takes physical possession of the goods.

To exercise the right of withdrawal, you must notify us (Garden Plants for Sale, Kleine Dries 25, 8600 Diksmuide, [email protected], Phone +32 (0)468 15 32 31) of your decision to withdraw from the contract by means of an unambiguous statement (e.g., a letter sent by post, fax, or email). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from the contract, we will reimburse all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us) without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw from the contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must send back or hand over the goods without undue delay, and in any event no later than 14 days from the day on which you communicate your decision to withdraw from this contract to us. You will meet the deadline if you send back the goods before the 14-day period has expired.

The direct costs of returning the goods shall be borne by you.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusions from the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of:

  • Products made to the consumer’s specifications or clearly personalized;
  • Products which are liable to deteriorate or expire quickly;
  • Products that cannot be returned for reasons of health protection or hygiene, once unsealed after delivery;
  • Products which, after delivery, are inseparably mixed with other items by their nature;
  • Audio or video recordings or computer software that has been unsealed after delivery;
  • Newspapers, periodicals, or magazines, except for subscription contracts for the regular delivery of such publications.
